Together with the brochure they govern your booking with MAB Casas Canarias (“we/us”) and apply to all members of your party (“you”).
We act as an agent between you and the owners of any accommodation you book through us. So far as other services such as flights or car hire are concerned, we can introduce you to reputable companies and forward your booking requests to them. However, any booking contracts you make for such services will be with those companies, subject to their standard terms and conditions (copies available on request - please allow 14 days).

1. Booking
When you book you must provide the correct deposit. Your booking becomes definite when we issue our confirmation and invoice.

2. Payment
Your booking is conditional upon your abiding by the payment terms which are as follows:-
• One quarter (25%) of total accommodation price is required to confirm your booking. This is non-refundable
• The balance to be paid 8 weeks before the rental period commences.
• If the booking is made less than 8 weeks before the commencement of the rental period, then the initial payment is for the total amount.
• Payment is debit or credit card.

3. Prices
All prices shown on our confirmation and invoice are in euros.
We reserve the right on behalf of the accommodation owners to pass on any price increases of which they notify us. If there is an increase which exceeds 15% of the original price, you have the option of cancelling your accommodation booking and receiving a full refund of all monies paid to us.

5. Travel Arrangements
Any travel, car hire or services other than the accommodation that you book are subject to the relevant supplier’s standard terms & conditions and do not form part of your arrangements with us.

6. Our Liability
We act solely as agents between you and the owners of the accommodation. We have no day to day control over the maintenance or contents of any accommodation and cannot be held liable for any defect in the accommodation (such as breakdown of domestic appliances, plumbing, wiring, etc.) or for any loss, damage or injury whatsoever you may suffer in connection with your booking for the accommodation except in so far as such loss, damage or injury is caused by our own negligence or breach of these booking conditions. However, we do try to inspect accommodation regularly to check its suitability and we will make all reasonable efforts in our power to assist you if you have a genuine problem with your accommodation, provided you report it to us.

7. Property Description
We try to ensure the accuracy of the information provided which is given in good faith and believed correct at the time of publication. Descriptions represent our personal opinion and any measurements and distances are estimated.

8. Older Properties
In choosing accommodation with us you have decided to use a firm that specialises in older properties of character in less developed parts of the Canary Islands. It follows that in some cases, plumbing, kitchens, etc. may take some getting used to. Animals, birds and insects are always present in the countryside and sometimes make their homes indoors. All this is normal and it is unreasonable to expect us to alter it for you. Only if, in the opinion of our local representative, there is an abnormal problem can we take any action.

9. Alteration By You
Should you wish to alter your booking, we will do our best to accommodate your wishes. However, alterations will be subject to an administration charge the amount of which will be notified to you prior to making the alteration(s). Alterations cannot be accepted within 42 days of your departure date and will be treated as cancellation giving rise to the charges below.

10. Cancellation By You
Any cancellation must be in writing. The following cancellation charges will apply:-
56+ days before departure deposit only
28-55 days before departure 50%
0-27 days before departure 100%
The personal insurance cover we offer gives wide-ranging cancellation cover.

11. Alteration/Cancellation By Us
If, after your booking has been confirmed, we are notified of a major change in the nature of your accommodation or that it is unavailable we will try to offer you suitable alternative accommodation. If the chosen alternative costs less than the original we will refund the difference. If no suitable alternative is found your booking will be cancelled and we will refund all monies you have paid us (excluding your insurance premium).
Changes in the nature of accommodation and their continuing availability are not within our control and therefore we will be under no obligation to you.

12. Complaints
If you have a complaint concerning your accommodation you should report it to our local representative within 24 hours who will try to contact the accommodation owner and/or do their best to resolve the problem. There is an answering service at our Gomera office as notified in our information pack.
In the unlikely event that you feel our representative has not tried to assist you or that you have any unresolved complaint concerning our services or the accommodation, you must write to us within 15 days of the date you leave the accommodation. Complaints concerning accommodation will be taken up with the owner. If you do not comply with our complaints procedure we and/or the accommodation owner may be put at a disadvantage and any rights you may otherwise have had to compensation will be substantially reduced or eliminated.

13. Your Responsibility
At all times you are responsible for any property hired or loaned to you and in your care. In addition you are responsible for:-
• avoiding causing nuisance to others by anyone in your party
• leaving your holiday accommodation in good order
• all members of the party taking proper precautions to ensure their own safety
• bearing the cost of any damage you do to the property, its contents or otherwise.
Under no circumstances should the numbers notified to us in advance be exceeded. Owners and our representatives are entitled to refuse admission and/or require those in excess of the maximum permitted number to leave

16. Jurisdiction
Your contract with us is governed exclusively by the laws of England, and the Courts of England and Wales will have exclusive jurisdiction to hear any dispute arising out of or in connection with it.
